1. Introduction

Welcome to SFT Brain, a spaced repetition flashcard platform operated by NutriGuide LLC ("we," "us," or "our"). SFT Brain is available as a web application, Chrome browser extension, and ChatGPT integration, designed to help you learn and retain knowledge more effectively through scientifically-backed spaced repetition techniques.

By accessing or using SFT Brain in any form, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

2. Account Registration

To use SFT Brain, you may need to create an account or sign in using a third-party authentication provider such as Google.

• You are responsible for maintaining the confidentiality of your account credentials
• You agree to provide accurate and complete information during registration
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account
• You must be at least 13 years of age to create an account

3. Acceptable Use

You agree to use SFT Brain only for lawful purposes. You may not:

4. Intellectual Property

You retain full ownership of all flashcards, study materials, and other content you create using SFT Brain. By using our service, you grant us a limited, non-exclusive license to store, process, and display your content solely for the purpose of providing the service to you.

Our Platform

SFT Brain, including its design, code, features, logos, and documentation, is the intellectual property of NutriGuide LLC and is protected by applicable copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of our platform without our prior written consent.

5. AI Features

SFT Brain incorporates AI-powered features, including but not limited to answer evaluation, flashcard generation from web content, and study recommendations. Please be aware of the following:

• Accuracy: AI-generated content, evaluations, and suggestions may not always be accurate, complete, or up to date. You should review and verify AI outputs before relying on them
• No Professional Advice: AI-generated content does not constitute professional, medical, legal, or expert advice of any kind
• Third-Party AI Services: Our AI features may be powered by third-party services such as OpenAI and Google Gemini. Your use of these features is also subject to the terms and policies of those providers
• Continuous Improvement: AI models and outputs may change over time as we update and improve the service

6. ChatGPT Integration

SFT Brain offers integration with ChatGPT through MCP (Model Context Protocol) tools, allowing you to manage your flashcards and study sessions directly within ChatGPT. By using this integration:

• You acknowledge that your flashcard data will be accessible to ChatGPT during your sessions
• You are responsible for ensuring that your use of the integration complies with OpenAI's usage policies
• We are not responsible for any actions taken by ChatGPT based on your flashcard data
• The integration requires authentication with your SFT Brain account and operates under the same account security responsibilities
• Availability and functionality of the ChatGPT integration may change based on third-party platform updates

7. Chrome Extension

The SFT Brain Chrome extension allows you to create flashcards from web content directly in your browser. By installing and using the extension:

• You grant the extension permission to read content from webpages you actively choose to use with the extension
• The extension only accesses page content when you explicitly interact with it; it does not monitor your browsing activity
• You are responsible for ensuring that creating flashcards from third-party content does not violate the intellectual property rights of the content owner
• The extension stores authentication tokens locally in your browser for session management
• You may uninstall the extension at any time through your browser settings

8. Subscription and Payments

SFT Brain is currently available as a free service. If we introduce paid plans or premium features in the future, we will provide advance notice and clearly communicate pricing, billing terms, and cancellation policies before any charges apply. Your continued use of a paid plan will constitute acceptance of the applicable payment terms at that time.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

• SFT Brain is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory
• We do not warrant that the service will be uninterrupted, error-free, secure, or free of viruses or other harmful components
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the service
• Our total liability for any claims arising from your use of the service shall not exceed the amount you paid us, if any, in the twelve (12) months preceding the claim
• We are not liable for any loss of data, including flashcards or study progress, due to service disruptions, technical failures, or account termination

10. Termination

We reserve the right to suspend or terminate your account and access to SFT Brain at our sole discretion, with or without notice, for conduct that we determine violates these Terms, is harmful to other users or the service, or for any other reason we deem appropriate.

You may also delete your account at any time. Upon termination or deletion:

• Your right to access and use the service will cease immediately
• We may delete your account data, including flashcards and study history, after a reasonable retention period
• Provisions of these Terms that by their nature should survive termination will remain in effect, including intellectual property, limitation of liability, and governing law

11. Changes to Terms

We may update these Terms of Service from time to time to reflect changes in our practices or for legal, operational, or regulatory reasons. We will notify you of significant changes by:

• Updating the "Last updated" date at the top of these Terms
• Sending an email notification to registered users
• Displaying a notice on our website or application

Your continued use of SFT Brain after any changes to these Terms constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of SFT Brain shall be resolved exclusively in the state or federal courts located in Santa Clara County, California.
