DMCA / Copyright Policy

1. Overview

SFT Brain, operated by NutriGuide LLC ("we," "us," or "our"), respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512, we respond to clear notices of alleged copyright infringement relating to content shared on our platform, including decks and flashcards that users make public or share with others.

This policy explains how copyright owners can submit a takedown notice, how affected users can submit a counter-notice, and our policy for terminating the accounts of repeat infringers.

3. Submitting a Notice of Copyright Infringement

If you believe that content available on or through SFT Brain infringes your copyright, you may submit a written notice to our Designated Agent at congminqiu@sftbrain.com. To be effective under the DMCA, your notice must include substantially the following:

• Identification of the copyrighted work claimed to have been infringed (or, if multiple works are covered by a single notice, a representative list of such works).
• Identification of the allegedly infringing material and information reasonably sufficient to permit us to locate it — for example, the specific deck or card name and the URL(s) of the material on SFT Brain.
• Your contact information, including your name, mailing address, telephone number, and email address.
• A good-faith statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
• A statement of accuracy and authority, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
• Your physical or electronic signature (the signature of the copyright owner or a person authorized to act on the owner's behalf).

Upon receiving a valid notice, we will act expeditiously to remove or disable access to the allegedly infringing material and will make a reasonable effort to notify the affected user.

4. Submitting a Counter-Notice

If you believe that material you posted was removed or disabled by mistake or misidentification, you may submit a counter-notice to our Designated Agent at congminqiu@sftbrain.com. To be effective, your counter-notice must include substantially the following:

• Identification of the material that was removed or to which access was disabled, and the location at which the material appeared before it was removed or disabled.
• A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
• Your contact information, including your name, mailing address, telephone number, and email address.
• A statement of consent to jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which we may be found), and that you will accept service of process from the person who submitted the original notice or that person's agent.
• Your physical or electronic signature.

If we receive a valid counter-notice, we may restore the removed material in 10 to 14 business days unless the original complaining party notifies us that they have filed a court action seeking to restrain the allegedly infringing activity.

5. Repeat Infringer Termination Policy

In accordance with the DMCA and other applicable laws, we maintain a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who are determined to be repeat infringers. A user may be considered a repeat infringer if they have been the subject of more than one valid notice of copyright infringement, or if their conduct otherwise demonstrates a pattern of infringing the intellectual property rights of others.

We may also, in our sole discretion, limit access to the service, remove content, or terminate the accounts of users who infringe the intellectual property rights of others, whether or not there is any repeat infringement.

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages. Do not make false claims.
